General conditions for using the site and services by advertisers
Presentation of Provence Promotion:
Provence Promotion is a non-profit-making association governed by the rules of the law of 1st July 1901 and based at Les Docks, 10 place la Joliette, BP 45607, 13567 Marseilles cedex 02, France.
Provence Promotion publishes the www.provencegobetween.com website, which offers services aiming to enable partnerships between companies through the Go Between In Provence program, for which a partner charter has been drawn up, considered to be an integral part of the program and which must be read and understood.
1) Description of the services offered by Provence Promotion:
a)Filing an advertisement:
This service is free and is offered to all individuals or legal entities outside of the Bouches du Rhône wishing to take over one or more companies or seeking partnerships or to create joint ventures. Advertisements must refer to industrial companies and firms and industry services established in the Bouches du Rhône.
The advertisements are referenced and put online by Provence Promotion (subject to meeting the selected criteria) and remain anonymous.
Provence Promotion can advertise or withdraw advertisements and terminate registrations at its discretion.
b)Consulting advertisements:
Consulting advertisements is governed by the clauses in the Go Between In Provence program and the charter.
c) Putting interested parties in contact with advertisers:
Contact requests by a Go Between In Provence member, acting on behalf of an interested party, are free and governed by the clauses of the program and charter (e.g. always through Provence Promotion which transmits it to the advertiser).
The advertiser has the member's details and contacts said member. Provence Promotion shall be kept informed of any developments and contacts in compliance with the non-disclosure obligations of the parties in question.
2) Registration and password:
The advertiser is solely responsible for the account and password and any action which may be carried out on the account with the password. Provence Promotion shall not be held liable for any loss or damage occurring as a result of failure to observe these obligations.
3) User rights - Copyright:
Provence Promotion is the sole owner of all the intellectual property rights on the www.provencegobetween.com website.
4) Liability:
Provence Promotion shall not be held liable for information communicated, or advertisements published under the advertisers' responsibility.
It shall not liable in any way to remedy a prejudice suffered by the interested parties or third parties regarding any event directly or indirectly related to the functioning or use of the site and service offered by Provence Promotion.
5) Applicable law . Assignment of jurisdiction:
The agreement is subject to French law.
Should there be contestation as to the interpretation or performance of the Agreement, and failing and out-of-court settlement, the Courts in the location of the head office of the association shall be the sole courts of competent jurisdiction.
Acceptance:
The advertiser hereby declares to have read the conditions for access, use and functioning of the Go Between In Provence program and the charter and all general conditions governing the www.provencegobetween.com website and hereby declares to agree with them and fully comply with them.
